THE TERMS OF PURCHASE/RETURN OF GOODS ARE MANAGED BY THE E-STORES OF THE COMPANY UAB "Danbalt International".
When purchasing goods from our e-shop, the customer must confirm that he has familiarized himself with these rules.
1. Basic provisions
These terms and conditions of purchase and sale (hereinafter referred to as "terms and conditions") stipulate the person purchasing goods from the www.danija.ee e-store (hereinafter referred to as the "buyer") and the company UAB "Danbalt International", company code 110474962, official address: Ozo g. 12A-1, LT-08200 Vilnius, Lithuania, (hereinafter referred to as "seller") mutual rights, obligations and liability when the buyer purchases goods from the e-store. By purchasing goods from the e-shop, the buyer agrees to the application of these terms and conditions
2. Conclusion of the purchase-sale agreement
2.1. The purchase and sale agreement between the buyer and the seller is deemed concluded from the moment when the buyer has placed the goods in the shopping cart in the e-store, provided the delivery address, selected the payment method, familiarized himself with these terms and clicks the "Order" button, and the agreement is valid until the obligations assumed are fully fulfilled. If the buyer does not agree to part or all of the conditions, he may not place the order.
3. Seller's rights
3.1. The seller has the right to suspend the operation of the e-shop temporarily or indefinitely without prior notice, and he is not responsible for any damages caused to the buyer that are caused by this. Orders submitted before the e-shop is suspended will be sent to the customer or the full amount received from the customer will be returned, and the buyer will be notified of this via the contact details provided by the customer.
3.2. The seller reserves the right to change these conditions by publishing the changed conditions on the e-shop website. The changes apply to all transactions made after the moment of publication of the terms and conditions.
3.3. The seller has other rights stipulated in the conditions and legislation of the Republic of Estonia.
4. Responsibilities of the seller
4.1. The seller undertakes to do everything so that the buyer can correctly use the services offered by the e-store. The seller does not give any guarantee that the e-shop will work continuously or that data transmission will be error-free. The seller is not responsible for any losses of the buyer related to errors in the e-store and (or) data transmission errors.
4.2. If the seller cannot deliver the goods ordered to the buyer due to important circumstances, he undertakes to offer similar goods or return the money paid by the buyer within 14 days. In such a case, the seller is released from responsibility for non-delivery of the goods.
4.3. The seller undertakes to comply with other requirements stipulated in these terms and conditions.
5. Buyer's rights
5.1. The buyer has the right to purchase goods from the e-store in accordance with these conditions and the legislation of the Republic of Estonia.
5.2. The buyer (consumer) has the right to withdraw from the purchase and sale contract concluded with the seller in the e-store by notifying the seller in writing within 15 days from the date of purchase of the goods. The buyer has the right to withdraw from the purchase and sale contract concluded with the seller only if the goods are of high quality, not damaged or fundamentally changed in appearance.
5.3. The buyer can return the goods to any store of the store chain throughout Estonia, having first logged in to his account and printed out the invoice. You can also return by courier - for this, please contact customer service.
5.4. The buyer has other rights stipulated in the conditions and legislation of the Republic of Estonia.
6. Obligations of the buyer
6.1. The buyer is obliged to pay the price of the goods and its delivery, as well as other payments (if they are specified when concluding the contract), and to accept the ordered goods. The buyer pays for the goods through his e-bank, which can be accessed from the e-store link (if the seller has a corresponding agreement with the buyer's bank), or by making a bank transfer from any other bank to the seller's account, the number of which is given in the "Requisites" section.
6.2. If the information provided in the buyer's registration form changes, the buyer must update it immediately.
6.3. The buyer must confirm the payment order in his e-bank, which can be accessed from the e-shop link (if the seller has a corresponding agreement with the buyer's bank), or make the payment from any other bank and inform the seller about this by a separate e-mail no later than 24 hours after he has clicked to the "Order" button. If the payment order is not confirmed within this term, the seller has the right to assume that the buyer has withdrawn from the purchase and sale contract. The goods selected by the buyer will be reserved and the seller will start executing the sales contract only when the seller receives a notification from the buyer's bank or the buyer about the payment made for the selected goods.
6.4. After placing the item in the shopping cart, the customer can use one discount coupon per purchase from the www.danije.ee e-store.
6.5. The buyer must comply with other requirements stipulated in the conditions and legislation of the Republic of Estonia.
7. Delivery of goods
7.1. Transport companies deliver goods on the territory of Estonia at the expense of the seller. In exceptional cases specified by the seller, the goods are delivered at the buyer's expense.
7.2. The exact delivery price depends on the place of receipt of the goods, so if the delivery address is included in the paid delivery places, you will know the final price only at the end of the order. If you want to order goods for paid delivery, we recommend contacting us via e-mail info@danija.ee and we will discuss suitable options.
7.3. Usually, the goods are delivered to the address specified by the buyer within 2-5 working days from the receipt of the payment for the goods and their delivery, if the goods are in the seller's warehouse. The Seller does not guarantee that the goods will be delivered within the above-mentioned term in any case, especially if the ordered goods are not in the Seller's warehouses. The goods are delivered throughout the territory of the Republic of Estonia.
7.4. The exact date and time of delivery of the goods will be indicated in the notification sent by the seller to the buyer via e-mail, which will be sent to the e-mail provided in the buyer's registration form. Consequently, after concluding the purchase and sale contract, the buyer undertakes to check this e-mail box every day until he has received a notification about the delivery of the goods.
7.5. During the delivery of the shipment, the buyer or, if necessary, the buyer's representative together with the representative of the transport company must check the condition of the package, the quantity, quality and selection of the shipped goods.
7.5.1. If the package of the shipment is found to be damaged, but no defects are found in the quantity, quality or completeness of the goods, the buyer or, if necessary, the buyer's representative must make a note about this in the data collector of the representative of the transport company or on the written delivery confirmation.
7.5.2. If inconsistencies are found in the quantity and/or quality and/or completeness of the goods, the buyer or, if necessary, the buyer's representative may not accept the shipment. In such a case, the representative of the transport company, together with the buyer or, if necessary, with the buyer's representative, completes a special act of inspection of the shipment, noting the detected defects there. In the event that the customer notices hidden defects, the normal warranty applies.
7.5.3. If the buyer or, if necessary, the buyer's representative accepts the shipment and signs about it in the data collector provided by the representative of the transport company or on the written delivery confirmation and the packaging is also damaged, the goods are considered delivered in damaged packaging, but its quantity, quality and completeness are considered to be in accordance with the terms of the purchase and sale agreement, and the additional services specified in the data collector or in the written delivery confirmation are properly provided. This does not apply to hidden defects in the goods.
7.5.4. If the buyer or, if necessary, the buyer's representative accepts the shipment and signs about it in the data collector provided by the representative of the transport company or on the written delivery confirmation and no other comments have been made there, the goods are considered delivered in undamaged packaging, its quantity, quality and completeness are considered to be in accordance with the terms of the purchase and sale agreement, and in the data collector or the additional services specified in the written delivery confirmation have been properly provided; in the event that latent defects should subsequently appear, the normal warranty applies.
7.6. If the goods have been delivered to the address specified by the buyer, they are considered delivered to the buyer, regardless of whether the goods were actually received by the buyer himself or by another person who did so at the given address. If the goods are not delivered on the scheduled delivery date, the buyer will notify the seller immediately, but no later than the next day after the scheduled delivery date of the goods. Otherwise, the buyer loses the right to submit claims to the seller in connection with non-delivery or late delivery of the goods.
8. Return of goods
8.1. If the buyer (consumer) withdraws from the purchase and sale contract, the goods will be taken back at the seller's expense, and the money paid by the buyer for the goods will be returned within 14 days after receiving the buyer's written notice of withdrawal.
8.1.1. The goods are returned in the original goods and shipping packaging together with the goods documents. That is, if the goods were in the original box or other packaging, the customer must also return the goods in the same packaging. This only applies to returns of new items within 14 working days of purchase. Before returning the goods, the buyer must definitely contact the seller by phone or e-mail info@danija.ee.
8.1.2. The buyer is responsible for the proper assembly and packaging of the returned goods (the returned goods must be: in good original packaging, preserved commercial appearance, with undamaged labels, unremoved protective films, etc. The returned goods must be properly packed in any bag to avoid damage to the packaging). If the goods are not fully assembled and (or) properly packaged, the seller will not accept the returned goods. The customer can always return the goods to any store in the chain without packaging them separately.
8.1.3. The goods will not be returned if they have been used and/or damaged and/or have lost their commercial appearance (changes in the appearance of the goods or packaging necessary to check the goods are not considered a significant change in the appearance of the goods), if the goods are returned as new and not under warranty.
8.2. If the buyer (consumer) does not like the shape, size, color, model or completeness of the purchased goods (except for goods provided by legislation, which the buyer does not have the right to exchange (return) if he does not like the shape, size, color, model or completeness of the goods), the buyer has the right to return the goods and get the money paid for it back.
8.3. In all cases of return, the buyer must first contact the customer service of the e-store at the given contacts and only after receiving information from the customer service, return the goods through the DPD Pickup point. When returning the shoes to the store, the buyer must know his order number and show the purchase receipt. The goods to be returned should be delivered to the store in the second half of the day, because in the morning the store may not have enough money to return the amount paid to the buyer.
8.4. If the purchased goods are of defective quality, the buyer has the right to submit claims to the seller regarding quality defects within the 2-year warranty period, i.e. during the 2-year warranty period, the buyer has the right to demand from the seller:
1) free elimination of product defects (product repair);
2) free exchange of a low-quality product for a high-quality product;
3) terminate the contract unilaterally and demand the return of the price paid for the goods.
9. Processing of personal data
9.1. By clicking the "Order" button, the buyer confirms that he and his representatives (the buyer has the consent of the representatives) agree to transfer his personal data to the seller and does not object to the seller processing the personal data provided by the buyer and/or his representatives for the identification of the buyer and/or his representative, (e -trade) for the purposes of concluding and fulfilling contracts and direct marketing. The seller confirms that he does not process the personal codes of the buyer (if it is a natural person) and his representatives for direct marketing purposes.
9.2. By ticking the "Newsletter subscription" box, the buyer confirms that he and/or his representatives (the buyer has the representatives' consent) agree that the personal data they provide to the seller will be disclosed to third parties selected by the seller for direct marketing purposes, as explained in the next sentence. By ticking "Newsletter subscription", the buyer confirms that he and/or his representatives (the buyer has the consent of the representatives) agree to receive from the seller and/or third parties chosen by him information and advertising materials about the services and goods specified in the buyer's registration form and/or his representatives at the addresses provided by and/or with SMS messages and/or calls to the specified mobile phone number and/or letters to the e-mail address.
9.3. By clicking the "Order" button, the buyer confirms that he (if the buyer is a natural person) and his representatives have been informed of their rights to get acquainted with the personal data processed by the seller and their processing methods, to demand the correction, destruction or suspension of their personal data if the data is processed in violation of the law, and also not to consent to the processing of your personal data.
9.4. By clicking the "Order" button, the buyer confirms that he and his representatives are aware of their right to refuse to provide personal data, but understand that personal data are necessary and indispensable for the unique identification of the buyer and/or his representatives for the purposes of concluding and fulfilling (e-commerce) contracts and that without consent to the provision of personal data and/or their processing, the seller cannot conclude and/or perform the contract.
10. Sending Information
10.1. The seller sends information about the fulfillment of the order to the e-mail address provided by the buyer in the registration form.
10.2. The buyer forwards all messages and questions using the contacts provided in the seller's e-shop (phone +372 880 4518 and e-mail at info@danija.ee).
11. Privacy Policy
11.1. All customer data is processed in accordance with the rules of the privacy policy.
